By signing below, the Captain/Responsible Party (“C/RP”), on behalf of C/RP, and/or on behalf of C/RP’s minor child(ren) as parent or guardian, if applicable, understands, acknowledges and agrees to any and all of the terms set forth in this contract, including, but not limited to, the following:
- I, and each seasonal court player, must affiliate with SPORTIME as a Member by completing and signing the appropriate documents and arranging to pay the applicable dues. I understand and agree that I am responsible for the full cost of the seasonal court(s).
- I understand that each seasonal court player, other than myself, must complete and sign the separate Seasonal Court Player Agreement, and that it is my responsibility to ensure that each player does so. Any player who does not do so, may not play.
- I understand that I must maintain my membership in good standing for the duration of the seasonal contract, as must all other seasonal attendees provided.
- Eligible SPORTIME Members may always fill-in seasonal games at no cost. An Associate/Non-Member may fill-in seasonal games up to three times per Associate/Non-Member; I understand and agree that the prevailing Seasonal Court Guest Fee will be charged to my account each time an Associate/Non-Member fills-in my seasonal game, and that I will be solely responsible for payment of such fee.
- Adjustments to the seasonal court schedule and all court assignments are at SPORTIME's sole discretion.
- When SPORTIME is responsible for lost playing time by reason of emergency or unexpected conditions, make-up time will be scheduled. Any make-up time approved by the Seasonal Coordinator must be completed by no later than May 19th of the Seasonal Schedule year reflected on this contract.
- SPORTIME DOES NOT GUARANTEE MAKE-UPS FOR SEASONAL COURT SESSIONS MISSED.
- The use of courts beyond assigned times will be subject to charge.
- SPORTIME reserves the right to terminate this contract at any time in its sole discretion, and SPORTIME’s sole liability shall be to refund any amounts previously paid, on a pro-rata basis. No refunds shall be given except as provided in this paragraph.
- Use of seasonal courts for organized programming, leagues, instruction or any other revenue generating purpose, other than by SPORTIME, is strictly prohibited and will result in immediate termination of this contract.
